Two drivers taken to hospital after head-on crash on M-46

Two 35-year-old men were taken to a hospital after a head-on crash Tuesday evening on M-46 in Reynolds Township.

The crash happened at about 6:07 p.m. Aug. 18 between Jones Road and Federal Road, according to Michigan State Police.

A preliminary investigation indicated the Pontiac driver crossed the centerline while trying to pass another vehicle, then hit an eastbound BMW head-on.

The Pontiac driver was a 35-year-old Howard City man. The BMW driver was a 35-year-old Lakeview man. Both were taken to Butterworth Hospital for treatment.

The crash remains under investigation.

Michigan no-fault benefits and injury claims after a car crash

Michigan no-fault law treats personal injury protection (PIP) benefits, and a fault-based injury claim as separate paths. Under MCL 500.3105, PIP benefits are payable without regard to fault, subject to the No-Fault Act and applicable coverage. Michigan Legal Center’s guide to Michigan PIP medical bills and priority explains why identifying the responsible insurer can depend on policy information and household coverage.

A separate claim for noneconomic damages, such as pain and suffering, depends on fault and the injury standard in MCL 500.3135. The law generally requires death, permanent serious disfigurement or a serious impairment of body function. Whether either path is available depends on the insurance, medical evidence and other facts.
