Elkton farmhand dies in Chandler Township crash

An Elkton-area farmhand died early Aug. 16 after a single-vehicle crash in Chandler Township.

Huron County Sheriff’s Office deputies were called shortly before 4 a.m. on Sunday, Aug. 16 to Elkton Road near Filion Road. When they got to the scene, they found a 2008 Chevrolet Malibu with one occupant, a 35-year-old man, the sheriff’s office said.

Preliminary information indicates the Malibu was traveling south on Elkton Road when it entered the east ditch north of Filion Road. The vehicle crossed the road, entered the west ditch south of the intersection, rolled over and caught fire, authorities said.

The Oliver Township Fire Department used the jaws of life to free the driver who was pronounced dead at the scene.

The sheriff’s office did not release his name. Sheriff Kelly Hanson said next of kin in Mexico had been notified, and an autopsy was scheduled for Aug. 17.

The Huron County Medical Examiner’s Office and sheriff’s office are investigating.

Michigan benefits and wrongful-death claims after a fatal car crash

For eligible dependents, MCL 500.3108 provides for certain survivor’s loss benefits after a qualifying fatal motor vehicle injury. Eligibility, coverage and available benefits depend on the insurance and household facts.

A wrongful-death claim is not automatic after a fatal crash. Under MCL 600.2922, it requires a wrongful act, neglect or fault by another person or entity, and the estate’s personal representative must bring the action. Michigan Legal Center’s wrongful-death deadlines guide explains why the applicable deadline depends on the underlying claim.
