Port Huron e-bike rider injured after crash with Jeep
A 20-year-old Port Huron man suffered minor injuries Sunday after his electric bicycle collided with a Jeep in Port Huron.
Port Huron Police Department officers responded at 2:16 p.m. Sunday, Aug. 16, to the intersection of Pine Grove Avenue and Prospect Place.
Police said the rider was heading south on the east sidewalk of Pine Grove Avenue at about 23 mph when he entered the intersection without stopping and traveled into the path of a Jeep Compass. The rider told officers he had “risked it” when entering the intersection.
The department said it found the rider at fault for failing to stop.
The collision left him partially pinned beneath the Jeep. Port Huron Fire Department personnel and Tri-Hospital EMS freed him before he was taken to McLaren Port Huron. He was later released with minor injuries.
The Jeep’s driver was not injured.
City Manager James Freed said the crash renewed concerns about high-speed e-bike use on sidewalks.
“Once again we see the dangers of e-bikes on city sidewalks moving at a high rate of speed and disregarding traffic laws. We continue to work on legislation to prevent these types of accidents,” Freed said.
No-fault benefits and injury claims after an e-bike crash
Michigan no-fault insurance benefits and a fault-based damages claim are separate. Personal protection insurance benefits may pay allowable medical expenses and certain other losses after a motor vehicle crash without first proving fault.
For a rider, MCL 500.3115 preserves applicable household policy coverage and directs the claim to the Michigan Assigned Claims Plan.
A separate damages claim against a driver requires proof that the driver was negligent and caused the injury. Comparative fault can reduce damages and may prevent recovery of noneconomic damages if the injured person is more at fault than all other people combined.
