74-year-old Flint pedestrian dies on Corunna Road
A 74-year-old Flint woman died after a driver hit her Friday in Flint Township.
Flint Township Police Department officers responded at about 4:50 p.m. Aug. 14 to Corunna Road near Interstate 75.
Preliminary findings indicate that a 34-year-old Flint woman hit the pedestrian as she crossed the road. First responders attempted lifesaving measures, but the she died from her injuries.
The driver stayed at the scene and cooperated with investigators. Police said alcohol and speed are not believed to have contributed to the crash.
Several lanes of Corunna Road were closed while investigators processed the scene. The Flint Township Fire Department, Genesee County Sheriff’s Office and Michigan State Police crash reconstruction team assisted.
The investigation remains ongoing. Anyone who witnessed the crash or has related information is asked to call Detective Lopez at 810-600-3250.
Michigan no-fault benefits and wrongful death claims after a pedestrian crash
Personal injury protection benefits are separate from a fault-based wrongful death claim. Michigan no-fault coverage can apply without determining who caused the crash. Coverage priority depends on the available policies and household relationships. When a pedestrian does not qualify for coverage under a personal or household policy, MCL 500.3115 directs the claim to Michigan’s assigned claims plan.
A wrongful death lawsuit is different because it requires proof that another person’s wrongful act, neglect or fault caused the death. Under MCL 600.2922, the personal representative of the estate must bring the action. The law permits a court or jury to award damages that may include reasonable medical, hospital, funeral and burial expenses, conscious pain and suffering, loss of financial support and loss of society and companionship.
