Michigan legal options after a fatal pedestrian crash
Michigan law treats possible no-fault benefits and a fault-based wrongful death claim as separate matters. Michigan Legal Center’s explanation of Michigan PIP medical bills and priority describes why available coverage depends on policy and household facts rather than a fault finding.
A separate wrongful death claim requires proof that another person’s wrongful act, neglect or fault caused the death. MCL 600.2922 requires such an action to be brought in the name of the estate’s personal representative. A police investigation and civil claim are separate, and neither automatically decides the other.
