West Branch man killed in M-76 crash near Alger

A 50-year-old West Branch man was killed in a crash shortly after midnight Thursday on M-76 near the Village of Alger.

According to WNEM, the Arenac County Sheriff's Office is investigating the crash, which happened on M-76 near Alger in Arenac County.

The sheriff's office said a Chevy Cobalt driven by Shawn Campbell, 50, of West Branch, crossed the center line and collided with a Ford F-150 driven by a 79-year-old Alger resident.

Campbell was killed in the crash.

Public reports did not state whether the Ford driver was injured or whether investigators believe speed, alcohol, distraction, weather, a medical issue, or roadway conditions contributed to the crash.

The crash remains under investigation.

Legal issues after a fatal center-line crash in Michigan

A fatal crash involving a vehicle crossing the center line can raise several legal and insurance questions. Investigators may review lane position, vehicle speed, road conditions, lighting, driver attention, possible medical issues, phone records, vehicle condition, event data, and witness statements.

Michigan no-fault benefits may be available after a motor vehicle crash without first proving fault under MCL 500.3105. If a person dies from crash-related injuries, survivor's loss benefits may also need review under MCL 500.3108, depending on coverage, dependency, household relationships, and the facts of the claim.

A wrongful death claim under MCL 600.2922 is a separate question. For the deceased driver's family, that claim would generally require evidence that another person, unsafe roadway condition, defective vehicle part, negligent maintenance, or another third party contributed to the crash. The current public report does not establish that.

If the Ford driver was injured, that person may have separate no-fault rights and may need to evaluate whether the facts support a claim for losses not covered by PIP. That analysis depends on the injuries, insurance coverage, and the completed crash investigation.

When possible, families should preserve insurance paperwork, vehicle information, repair records, photographs, medical and funeral records, witness information, and any Arenac County Sheriff's Office crash report or reconstruction materials.
