Motorcyclist stable but in serious condition following Ann Arbor area crash
A 23-year-old Ann Arbor man is in serious condition after a Pittsfield Township crash on Monday.
At around 7:11 p.m. on Monday, June 15, Pittsfield Township Police Department responded to an accident involving a car and a motorcycle at a shopping center.
The motorcyclist was traveling west of Washtenaw Avenue near Torrey Avenue when he hit the other vehicle. The other car was driving by a 51-year-old Florida resident that was turning into the Glencoe Crossing Shopping Center.
The motorcyclist was taken to the hospital with serious injuries but is listed in stable condition as of Tuesday afternoon. The motorcyclist had not been wearing a helmet. No other people were injured.
Police believe the speed of the motorcycle was a factor in the crash, which is still under investigation.
Legal options after a motorcycle accident
When a Michigan motorcycle crash involves a car or other motor vehicle, the insurance analysis can be different from an ordinary car-occupant claim. MCL 500.3114 has specific priority rules for a motorcycle operator or passenger injured in an accident that shows evidence of motor-vehicle involvement.
Michigan is a no-fault state, which means that without having to determine whose fault an accident is, people injured in the crash may qualify for Personal Injury Protection benefits.
These benefits can help cover economic losses from the crash such as allowable medical expenses, wage loss, replacement services or attendant care. Recovering noneconomic losses usually requires a separate claim against an at-fault driver. This would only be an option if the injuries meet the state’s threshold of serious impairment of body function, permanent serious disfigurement or death.
