Motorcyclist killed in head-on crash on White Lake Drive
A 35-year-old Twin Lake man was killed late Sunday after his motorcycle collided head-on with a car.
The crash happened at about 11:03 p.m. Sunday, July 12, on White Lake Drive between Durham Road and Cogswell Avenue in Fruitland Township, according to the Michigan State Police.
The preliminary police investigation found that an 18-year-old Whitehall woman was driving eastbound on White Lake Drive when she collided head-on with the motorcycle, which was traveling west in the eastbound lane.
The motorcyclist was pronounced dead at the scene. The other driver was not injured.
White Lake Drive remained closed between Durham Road and Cogswell Avenue while troopers investigated, and drivers were asked to avoid the area.
Legal issues after a fatal Michigan motorcycle crash
Michigan is a no-fault state. Personal protection benefits are available for people injured in an accident without first having to prove fault.
When a motorcycle crash also involves a car, Michigan law has specific insurance priority rules under MCL 500.3114. Available coverage can depend on the vehicles involved, the insurance policies and other facts.
If someone died in the accident, Michigan's wrongful death law may allow the person's family or representative to bring a claim. Damages may include medical and funeral expenses, loss of financial support or services, and survivors' loss of society and companionship.
A wrongful death claim is separate from any criminal investigation and depends on evidence, causation and insurance coverage.
Michigan law generally requires drivers to use the right half of the roadway, subject to exceptions, under MCL 257.634.
