Michigan no-fault benefits and injury claims after a motorcycle crash
Michigan treats motorcycle crashes differently when they involve a motor vehicle. Under MCL 500.3114(5), an injured motorcycle operator or passenger must seek personal protection insurance benefits through a motorcycle-specific order of priority.
These benefits are separate from a fault-based injury claim. Under MCL 500.3135, noneconomic damages are available only when the injured person has suffered death, a serious impairment of body function or permanent serious disfigurement. A separate claim still depends on proof of fault and the statutory injury threshold.
Michigan Legal Center explains how motorcycle accident claims and no-fault benefits involve different insurance and liability questions.
