Two people sustain minor injuries including public safety officer
A head on crash in Kalamazoo early morning Wednesday involved a Kalamazoo Public Safety (KDPS) Officer, injuring them and another driver.
The crash took place at around 9 a.m. on Wednesday, July 15 in Kalamazoo.
Both drivers were taken to hospitals for treatment, according to the KDPS. The officer was later released.
A preliminary investigation found the officer was not at fault. The other driver was cited for failing to yield to oncoming traffic and driving with a suspended license.
The investigation remains open.
Legal Questions After a Crash Involving a Police Vehicle
Michigan is a no-fault state, which means that an injured person may qualify for Personal Injury Protection benefits without having to determine whose fault an accident is.
These benefits can help cover economic losses for injuries caused by the crash such as allowable medical expenses, wage loss, replacement services or attendant care.
Recovering noneconomic losses usually requires a separate claim against an at-fault driver. This would only be an option if the injuries meet the state’s threshold of serious impairment of body function, permanent serious disfigurement or death.
Michigan law generally gives governmental agencies broad immunity when they are performing governmental functions, with limited statutory exceptions. A city or county is not automatically liable for an officer’s conduct. Liability usually requires a policy, custom or failure to train.
