Woman killed in Detroit crash at Collingwood and Belleterre streets

A woman in her 40s was killed and a man in his 40s was injured Friday evening in a two-vehicle crash at Collingwood and Belleterre streets in Detroit.

An emergency call came in at 7:39 p.m. July 10, according to CBS Detroit. Detroit police said one driver was traveling at a high rate of speed on Collingwood, disregarded a stop sign and struck the other vehicle.

The woman was driving the vehicle that was hit and died at the scene, FOX 2 Detroit reported. A male passenger was taken to a hospital. CBS reported that his medical condition was not available.

Police took the suspected driver into custody and continued investigating. Public reports did not identify the people or vehicles, name any charges or provide a crash-report number.

Legal Issues After a Fatal Stop-Sign Crash

Detroit police's preliminary account raises stop-sign and speed questions, but it is not a final civil-liability finding. MCL 257.649 requires drivers to stop at stop signs and yield to close traffic. Intersection video and the completed police reconstruction could matter.

No-Fault benefits are separate from civil liability. MCL 500.3105 may apply to the injured man's personal protection insurance (PIP) claim, while MCL 500.3108 addresses survivor's loss for qualifying dependents. A wrongful death action under MCL 600.2922 is brought by the estate's personal representative and requires proof of a wrongful act, neglect or fault.
