Michigan no-fault and wrongful-death claims after a motorcycle crash

Personal injury protection (PIP) benefits and a fault-based claim are separate. Michigan’s motorcycle priority statute, MCL 500.3114, says a motorcycle operator or passenger injured in an accident involving a motor vehicle must seek PIP benefits through a special order of insurers. Michigan Legal Center’s guide to Michigan motorcycle accident claims and no-fault benefits explains how vehicle roles and available insurance policies affect that analysis.

A wrongful death case is different because it requires proof that another person or company was legally responsible. Michigan’s wrongful-death statute, MCL 600.2922, applies when another’s wrongful act, neglect or fault caused the death and requires the estate’s personal representative to bring it. The fact that a death occurred does not establish fault by itself.
