Michigan no-fault survivor benefits and wrongful death claims after a fatal crash
Michigan no-fault survivor benefits and a wrongful death lawsuit are separate legal paths. Under MCL 500.3108, eligible dependents may seek survivor’s loss benefits for certain lost financial support and expenses for replacement services, subject to insurance coverage, dependency requirements and statutory limits.
A separate wrongful death lawsuit depends on proof that another person or company was legally at fault. Depending on the facts, damages may include reasonable medical, hospital, funeral and burial expenses, lost financial support, compensation for conscious pain and suffering and loss of society and companionship.
Michigan Legal Center’s explanation of Michigan wrongful death deadlines describes why the filing period can depend on the underlying claim and special notice requirements. Neither no-fault benefits nor a wrongful death claim is automatic.
