Michigan claims after a fatal truck equipment failure
An estate may pursue a wrongful death claim when a truck defect or negligent maintenance caused a death. A malfunction alone does not establish either a defect or negligence.
The affected parts, service records and operating instructions can help distinguish a defect from wear, improper repairs or later changes. Michigan Legal Center’s defective product injury guidance explains why this evidence should be preserved before equipment is repaired, returned or discarded.
