Grand Rapids worker hospitalized after detached garage collapses during dismantling
A worker was taken to the hospital Tuesday afternoon after a detached garage collapsed while a crew was dismantling it in Grand Rapids.
The collapse happened just before 12:30 p.m. at a home on Highland Street SE near College Avenue SE, according to the Grand Rapids Fire Department.
Fire officials said the worker was trapped under the structure after it came down. People at the scene were able to lift it enough to pull him out before he was taken to the hospital.
The worker was alert and conscious when firefighters arrived. Officials said his injuries were not life-threatening.
The cause of the collapse has not been released.
Workers’ compensation after a Michigan construction injury
A worker who is an employee may qualify for workers’ compensation benefits after an injury that arises out of and in the course of employment.
Under MCL 418.301, those benefits can include medical treatment and wage loss benefits when the injury prevents the worker from earning wages.
Medical benefits should generally be available from the day of the injury, while wage loss benefits depend on the length of disability and other facts.
The worker’s employment status and insurance coverage can matter because an employee, an independent contractor and a self-employed worker may have different benefit options.
Michigan employers must report a work related injury or hospital trip to MIOSHA within 24 hours.
When a third party may be liable after a demolition collapse
A worker still might have a claim against a separate person or company whose negligence contributed to an injury. Under MCL 418.827, a worker is allowed to pursue a claim against a liable third party in appropriate circumstances.
After a structure collapses during dismantling, liability can depend on who controlled the work, planned the demolition, gave directions, supplied equipment or was responsible for site conditions. The reports do not establish why this garage fell or whether anyone acted negligently.
