Compensation after a fatal bicycle crash in Michigan
When a driver's negligence causes a bicyclist's death, Michigan law allows a wrongful death claim if the rider could have recovered damages had they survived. Under MCL 600.2922.
Recoverable damages can include reasonable medical, funeral and burial expenses the estate owes, the rider's conscious pain and suffering between injury and death and eligible survivors' loss of financial support and companionship.
Michigan Legal Center's explanation of bicycle and e-bike accident claims describes why a rider may qualify for no-fault benefits despite being outside a car. When coverage applies, those benefits don't depend on proving another driver was at fault and can include medical and funeral expenses, subject to coverage and statutory limits.
