82-year-old bicyclist killed in Battle Creek crash
An 82-year-old Bedford Township man died after a vehicle hit him while he was riding his bicycle Tuesday, Nov. 3.
Battle Creek Police Department officers responded shortly after 2:30 p.m. to Helmer Road South near Cherrywood Lane.
Police said he was riding north when a southbound vehicle driven by a 35-year-old Battle Creek man crossed the center line and hit his bicycle.
The officers performed CPR until Battle Creek Fire Department and LifeCare Ambulance crews arrived and continued medical care. He was pronounced dead at the scene.
The driver stayed at the scene and was interviewed. Police said the crash remains under investigation.
In a Nov. 5 statement, the police department said the city, police and fire departments “express our sincere condolences to the family and loved ones of the victim in this incident.”
Who can file a wrongful death claim after a Michigan bicycle crash?
The personal representative of the deceased person's estate brings a Michigan wrongful death lawsuit on behalf of the estate and eligible survivors. Michigan's wrongful death law requires a wrongful act, neglect or fault that caused the death and would have allowed the person to sue if they had survived.
Depending on the evidence, damages may include reasonable medical, hospital, funeral and burial expenses for which the estate is liable, conscious pain and suffering between injury and death and eligible survivors' loss of financial support, society and companionship.
Estate appointments can also affect the time available to file. Michigan Legal Center's guide to Michigan wrongful death deadlines explains why the type of claim and the personal representative's appointment must be reviewed together.
