3 Killed in I-94 Semi Crash Near Dearborn
Three people were killed late Friday after a passenger vehicle hit a semi-truck that had stopped in flood traffic on eastbound I-94 near Michigan Avenue, according to Michigan State Police.
Troopers responded around 11:44 p.m. on July 3. MSP said the semi-truck was stopped because of flooding on the freeway when the passenger vehicle struck it from behind.
Three occupants of the passenger vehicle were pronounced dead at the scene. MSP said all three victims had been identified. Public reports used for this story did not list their names or ages.
The surviving driver of the passenger vehicle was taken into custody. Public reports did not identify a charge or explain the custody decision.
MSP said the investigation remained ongoing. The freeway later reopened and all lanes were open.
Legal Issues After a Fatal I-94 Semi-Truck Crash
A fatal crash involving passengers can raise several different legal questions at the same time. The police report, witness accounts, roadway-flooding timeline, vehicle damage, and any available video or vehicle data may matter before anyone can fairly assess fault.
Michigan No-Fault issues can also matter after a fatal motor-vehicle crash. MCL 500.3105 addresses when No-Fault benefits arise from the ownership, operation, maintenance, or use of a motor vehicle, and MCL 500.3108 addresses survivor's loss benefits after a death.
A wrongful death claim under MCL 600.2922 is separate from the No-Fault benefit question and depends on evidence that a wrongful act, neglect, or fault caused the deaths. The current public reports do not identify charges, make a final fault finding, or say the semi driver or trucking company caused the crash.
