Man dies after Midland County school bus crash

Dallan Sweebe, 27, died after a crash involving a school bus carrying students Monday morning in Homer Township.

The Midland County Sheriff's Office said the Oct. 5 crash happened on East Isabella Road, east of North Homer Road.

Sweebe was driving a Toyota Corolla west when he rear-ended a Midland Public Schools bus. A 73-year-old Saginaw man was driving the bus.

He was taken to the University of Michigan Medical Center, where he died.

Some people aboard the bus reported minor injuries but declined medical evaluation and treatment at the scene.

Is the following driver automatically at fault in a Michigan rear-end crash?

No. Under Michigan’s rear-end collision law, evidence that a vehicle rear ended another on a Michigan highway creates a presumption of negligence. The following driver is initially presumed to have acted carelessly but can challenge that presumption with evidence of an adequate excuse or justification.

For a crash between one hour after sunset and one hour before sunrise, the owner cannot invoke the rule if the vehicle lacked a rear light reasonably visible to approaching drivers.
