Two killed in Macomb Township head-on crash

Two men died after a pickup truck and a van collided head-on Tuesday night.

Macomb County Sheriff's Office deputies responded at about 11:18 p.m. Sept. 29 to 23 Mile Road at Lancelot Drive.

The sheriff's office preliminary investigation found that a black Chevrolet Silverado was heading west without its headlights on. The pickup crossed into the eastbound lane and hit a white Chevrolet Express van head-on.

The van's driver, a 30-year-old Macomb Township man, was pronounced dead at the scene. The pickup's driver, a 60-year-old Harrison Township man, was taken to a hospital, where he later died.

The investigation remains ongoing.

Can a wrongful death claim proceed if the at-fault driver dies?

Yes. Under MCL 600.2921, claims survive a person's death, so an at-fault driver's death does not by itself prevent a claim against the driver's estate.

Under MCL 600.2922, the personal representative appointed to act for the deceased person's estate must bring the wrongful death lawsuit. The claim must establish wrongful conduct that caused the death and would have entitled the person to recover damages if they had survived.

Damages may include reasonable medical and funeral expenses owed by the estate, conscious pain and suffering before death, loss of financial support and loss of society and companionship.
