Two hospitalized in Walled Lake crash

Two hospitalized in Walled Lake crash

A driver and passenger were taken to a hospital after a crash Saturday evening, Oct. 17.

The crash happened on Decker Road south of Pontiac Trail in Walled Lake. A witness said both occupants appeared unconscious after first responders removed them from the vehicle.

Can an injured passenger sue their own driver in Michigan?

Yes, if the driver's negligence caused the passenger's injuries and the claim meets Michigan's legal requirements. Riding in the responsible driver's vehicle doesn't prevent a passenger from bringing an injury claim.

For pain and suffering, MCL 500.3135 generally requires death, serious impairment of body function or permanent serious disfigurement. A serious impairment must be observable by someone other than the injured person, affect an important body function and affect the person's general ability to live normally.

Separately, an eligible passenger may receive no-fault benefits for covered medical care and lost income regardless of who caused the crash. Available benefits depend on coverage and statutory eligibility. Michigan Legal Center explains the distinction between these benefits and a claim against a driver in its discussion of passenger injury claims after a Michigan car accident.
