Pedestrian injured in U.S. 10 semitruck crash in Bay County

Pedestrian injured in U.S. 10 semitruck crash in Bay County

A pedestrian was taken to a hospital Wednesday morning after being hit by a semitruck on U.S. 10.

Michigan State Police Tri-City Post troopers responded to the crash near South Carter Road in Williams Township in Bay County. The semitruck driver called 911 about 5:50 a.m. Oct. 28 and reported hitting someone who had been parked along the road.

The severity of the pedestrian’s injuries wasn’t immediately available.

Troopers closed westbound traffic at Garfield Road, Exit 132, and asked drivers to use alternate routes while they investigated.

No-fault benefits and injury claims after a Michigan pedestrian crash

Pedestrians injured by a motor vehicle may qualify for personal injury protection benefits regardless of who caused the crash. Depending on eligibility and available coverage, those benefits can pay for reasonably necessary medical care and part of lost wages.

Under MCL 500.3115, a pedestrian’s claim generally starts with applicable coverage through their own auto policy, a spouse’s policy or a relative who lives in the same household. If none applies, the Michigan Assigned Claims Plan may provide benefits, subject to eligibility and limits. Michigan Legal Center’s explanation of Michigan PIP medical bills and priority describes why the driver’s insurance isn’t automatically responsible for an injured pedestrian’s medical bills.

A separate claim against an at-fault driver may provide compensation for pain and suffering if the injury meets Michigan’s threshold of serious impairment of body function, permanent serious disfigurement or death. A serious impairment must be observable by someone else through actual symptoms or conditions, affect an important body function and affect the person’s general ability to lead their normal life. A pedestrian’s share of fault reduces pain-and-suffering compensation and bars it if they were more than 50% at fault.
