Pedestrian hospitalized after M-89 crash in Otsego Township

A pedestrian was hospitalized after being hit by an SUV Thursday night, Oct. 8, in Allegan County.

The Allegan County Sheriff's Office said the crash happened at M-89 and Cross Oaks Mall Drive in Otsego Township. The driver wasn't injured.

The sheriff's office's crash reconstruction team investigated at the scene. Eastbound M-89 between 13th Street and Oaks Crossing Drive was closed Thursday night while deputies worked in the area.

Who pays a pedestrian's medical bills in Michigan?

An injured pedestrian may qualify for personal injury protection (PIP) benefits even though they weren't in a vehicle. PIP can pay for necessary treatment and rehabilitation related to the crash, subject to coverage limits and eligibility rules. These benefits don't depend on proving that a driver caused the crash.

If no such coverage applies, an eligible pedestrian can seek benefits through the Michigan Assigned Claims Plan under MCL 500.3115. The plan assigns qualifying claims to an insurer, but it doesn't automatically cover someone who's disqualified from no-fault benefits.

Ask the auto insurer whether a personal or household policy covers the pedestrian before assuming the driver's insurer will pay. Michigan Legal Center explains how these coverage rules determine who pays medical bills after a Michigan crash.
