Michigan survivor benefits after a fatal single-vehicle crash

Qualifying dependents may receive no-fault survivor’s loss benefits after a fatal single-vehicle crash, even without proof that another driver was at fault. Eligibility depends on insurance coverage, dependency and statutory exclusions.

Under MCL 500.3108, these benefits can replace financial support the deceased would have provided to people who were dependents at the time of death. They can also pay reasonable expenses for ordinary and necessary services the deceased would have performed for those dependents, up to $20 a day. Benefits last only while dependency continues and aren’t payable beyond the first three years after the crash. A combined limit applies to all dependents’ benefits for each 30-day period.

Michigan Legal Center’s explanation of personal injury protection benefits and insurance priority describes how coverage and the rules for choosing the responsible insurer can affect payment.
