Fatal Olive Township cement truck crash
One person died and four others were critically injured after colliding with a cement truck Monday afternoon.
The vehicles collided at 120th Avenue and Stanton Street in Olive Township. The Ottawa County Sheriff's Office said the crash happened shortly before 2:30 p.m. Monday, Oct. 5.
Deputies preliminary investigation showed the Toyota's driver failed to yield at the intersection as the cement mixer headed north on 120th Avenue.
Five people were in the Toyota, and several were pinned inside after the collision. The four surviving occupants were taken to hospitals by helicopter and ambulance.
Deputies closed the intersection, and the sheriff's office said the crash remained under investigation.
Can a passenger sue their own driver after a Michigan crash?
Yes, if the driver's negligence caused the passenger's injuries and Michigan's legal requirements are met. A claim may involve the passenger's own driver, another driver or both, as Michigan Legal Center explains in its discussion of Michigan passenger injury claims.
For pain and suffering, MCL 500.3135 generally requires death, serious impairment of body function or permanent serious disfigurement.
Personal injury protection benefits are separate and are payable without regard to fault for eligible injuries. They can cover qualifying medical expenses and part of lost wages, subject to coverage limits and other legal requirements.
