Driver seriously injured in Fillmore Township crash

A driver was hospitalized with serious injuries Wednesday night after crashing into the back of a pickup truck.

The crash happened shortly before 8 p.m. Oct. 7 on Lincoln Road at 138th Avenue, according to the Allegan County Sheriff’s Office.

Deputies said the pickup was stopped in the northbound lane to turn left when another northbound vehicle hit it from behind.

The driver of the second vehicle was pinned inside and had to be freed before being taken to a hospital. The pickup driver was not injured.

Is the rear driver always at fault in Michigan?

No. Under MCL 257.402, rear ending another car creates a presumption of negligence, that presumption can be rebutted with evidence.

The presumption doesn't apply if the crash happened between one hour after sunset and one hour before sunrise and that vehicle had no light reasonably visible to approaching drivers from the rear.
