Construction worker hit in Emmet County hit-and-run
A construction worker was struck in a hit-an-run crash Wednesday, Sept. 16.
Michigan State Police Gaylord Post troopers said the crash happened around 2:25 p.m. near U.S. 31 and Brutus Road in Emmet County.
The preliminary investigation indicated that an older man driving a black Chevrolet SSR hit the worker before continuing south on U.S. 31.
Police rerouted traffic and warned motorists to expect heavy delays and avoid the area.
Michigan benefits and claims for injured road workers
An employee injured by a vehicle while performing road construction work may qualify for workers’ compensation. Benefits can include medical treatment, wage replacement and rehabilitation when the injury and employment meet Michigan’s requirements. The Michigan Workers’ Disability Compensation Agency advises employees to report a work injury to their employer immediately.
Under MCL 500.3109, overlapping workers’ compensation benefits provided or required by law are subtracted from PIP benefits otherwise payable for the injury. Accepting workers’ compensation does not automatically prevent a separate claim against an at-fault driver who is outside the worker’s employment. MCL 418.827 permits claims against legally responsible third parties other than the employer or a coworker.
