Legal options after a Michigan pedestrian crash
Michigan is a no-fault state. A pedestrian injured by a motor vehicle may qualify for Personal Injury Protection benefits without first proving who caused the crash, as long as they have car insurance or their spouse or another relative does.
A separate claim against an at-fault driver for pain and suffering is generally available only when the injury involves death, permanent serious disfigurement or a serious impairment of body function under MCL 500.3135.
Michigan’s traffic-signal law requires drivers to yield to pedestrians in an intersection or adjacent crosswalk. Fault in a pedestrian crash can depend on traffic signals, crosswalk location, vehicle movements, speed, visibility and whether a driver or pedestrian followed the rules.
