Woman killed, three hospitalized in Holland Township crash

A 62-year-old Holland woman died and three other people, including a 1-year-old boy, were hospitalized after two SUVs collided Tuesday evening.

The crash happened about 7:12 p.m. Sept. 29 at the intersection of Butternut Drive and James Street, according to the Ottawa County Sheriff's Office.

Investigators said a GMC Acadia was speeding when it collided with a Jeep Grand Cherokee making a left turn onto James Street.

The woman who died was a passenger in the Jeep. Another passenger, a 62-year-old Holland man, was airlifted to a hospital. The Jeep's driver, a 22-year-old Holland woman, and the boy were also taken to a hospital. A 22-year-old Holland man who was also a passenger was not injured.

The GMC's driver, a 36-year-old Holland woman, was not injured. The sheriff's office said Wednesday that she was arrested at the scene on suspicion of operating while intoxicated.

The crash remains under investigation. Anyone with information is asked to call the sheriff's office at 616-738-4003.

Michigan impaired driving laws after a fatal crash

Michigan prohibits driving under the influence of alcohol or drugs on public roads. Under MCL 257.625, operating while intoxicated and causing another person's death is a felony. The offense requires proof of prohibited driving and that the vehicle's operation caused the death. An arrest on suspicion of intoxication doesn't establish those facts.

A civil lawsuit seeks compensation separately from criminal punishment, a distinction Michigan Legal Center explains in its discussion of civil claims after a Michigan drunk driving crash.
