Woman killed in Montcalm County crash on Hillman Road

Woman killed in Montcalm County crash on Hillman Road

A 41-year-old Stanton woman died after her SUV overturned, hit several trees and caught fire Monday evening.

The Montcalm County Sheriff's Office said the crash occurred around 7:22 p.m. Oct. 19 on North Hillman Road near Beechwood Drive.

She was driving a 2017 Buick Enclave when she lost control and ran off the road. The SUV overturned and hit the trees before catching fire.

Neighbors extinguished the fire before first responders arrived. She was the only person in the vehicle and was pronounced dead at the scene.

Deputies said speed appears to have been a factor. The crash remains under investigation.

Michigan survivor benefits after a fatal single-vehicle crash

Qualifying dependents may receive no-fault survivor's loss benefits after a fatal crash involving just one vehicle. These benefits don't require proof that another driver caused the crash, but insurance eligibility and statutory exclusions still apply.

Under MCL 500.3108, survivor's loss benefits can replace financial support the deceased person would have provided during the dependents' dependency. Benefits are subject to a combined monthly maximum and aren't payable beyond the first three years after the crash.

A wrongful-death lawsuit is separate from those insurance benefits. It requires a wrongful act, neglect or fault by another person or entity that would have supported a lawsuit if the deceased person had survived. The estate's personal representative must bring the action. Michigan Legal Center explains the filing and estate requirements in its information on Michigan wrongful death deadlines.
