Who can file a Michigan wrongful-death lawsuit?

Under MCL 600.2922, a wrongful-death lawsuit must be brought by the personal representative of the deceased person's estate and requires a wrongful act, neglect or fault that caused the death and would have allowed the person to recover damages if they had survived.

Depending on the evidence, recoverable losses may include reasonable medical, hospital, funeral and burial expenses the estate owes, conscious pain and suffering between the injury and death, lost financial support and loss of society and companionship.

Filing authority and timing need separate review. Michigan Legal Center explains how the underlying claim affects Michigan wrongful death deadlines.
