Two injured in Inkster pedestrian crash including 12-year-old
Two pedestrians, including a 12-year-old girl, were seriously hurt Thursday morning after being hit by a car.
The crash happened shortly after 6 a.m. Oct. 8 near Inkster Road and Avondale Street. The Inkster Police Department is investigating.
The girl was reported in serious but stable condition Thursday morning.
The Garden City Police Department was assisting with the investigation. The circumstances leading to the crash were not yet known.
Insurance and injury claims after a Michigan pedestrian crash
A Michigan resident injured by a motor vehicle while walking may qualify for personal injury protection (PIP) benefits, regardless of who caused the crash. PIP can cover reasonable charges for reasonably necessary medical care and rehabilitation, subject to applicable coverage and legal limits.
Under MCL 500.3115, an eligible pedestrian without applicable coverage can seek benefits through the Michigan Assigned Claims Plan.
A separate claim against an at-fault driver can seek compensation for pain and suffering. If they can show the driver’s negligence caused an injury that meets Michigan’s threshold of a serious impairment of body function or permanent serious disfigurement.
Shared fault can reduce pain-and-suffering damages, and a pedestrian who is more than 50% at fault cannot recover those damages.
