Three killed in Lodge Freeway crash near Wyoming Avenue

Three killed in Lodge Freeway crash near Wyoming Avenue

A driver and two passengers from Detroit died after their vehicle went airborne and hit a concrete barrier early Sunday.

Michigan State Police troopers responded around 2 a.m. Nov. 1 on the southbound Lodge Freeway near Wyoming Avenue.

The preliminary investigation indicated the driver failed to navigate a curve. Her vehicle left the freeway, went up an embankment and through shrubbery, then became airborne. It landed on the entrance ramp from Wyoming Avenue before hitting the barrier.

Investigators said alcohol and speed were “suspected to have been contributing factors in the crash.” Police said the investigation was ongoing.

Can a passenger’s family pursue a claim if the driver also dies?

Yes. If a driver’s negligence causes a passenger’s death, Michigan’s law preserving claims after death allows an otherwise valid claim to continue against the driver’s estate.

The lawsuit must be brought by the passenger’s personal representative, the person legally authorized to act for the estate. Eligible survivors may seek damages for loss of companionship.

A lawyer should review the estate proceedings, available liability insurance and filing deadlines together. Michigan Legal Center’s explanation of Michigan wrongful death deadlines describes how the underlying claim and estate appointment can affect that review.
