Michigan wrongful death claims after a pedestrian crash
When a driver's negligence causes a pedestrian's death, a wrongful death lawsuit may allow recovery for the resulting losses. Michigan's wrongful death law, MCL 600.2922, requires the lawsuit to be brought by the personal representative of the deceased person's estate. A family relationship alone does not give someone authority to file the lawsuit.
Recoverable damages can include reasonable medical, hospital, funeral and burial expenses for which the estate is liable, conscious pain and suffering between injury and death, loss of financial support and loss of companionship. The available damages depend on the losses proved and who qualifies under the statute.
The underlying claim also affects the time available to sue. Michigan Legal Center's explanation of Michigan wrongful death deadlines discusses filing periods and how estate appointments can affect them.
