Who can file a Michigan wrongful-death lawsuit?

A wrongful-death lawsuit are brought by the personal representative of the deceased person's estate. Relatives don't each file a separate wrongful-death lawsuit.

A claim requires a wrongful act, neglect or fault that caused the death and would have allowed the person to recover damages if they had survived. Depending on the evidence, damages may include reasonable medical and funeral expenses for which the estate is liable, conscious pain and suffering before death, loss of financial support and loss of companionship.

The underlying type of claim affects the filing deadline. Michigan Legal Center explains that distinction and the estate representative's role in its discussion of Michigan wrongful death deadlines.
