Wrongful death claims after a fatal Michigan crash
A wrongful death claim may be available when another person’s negligence, or failure to use reasonable care, causes a fatal crash. Under MCL 600.2922, the estate’s personal representative, the person authorized to act for the estate, must bring the lawsuit.
Depending on the evidence, compensation may include reasonable medical, funeral and burial expenses for which the estate is responsible, the deceased person’s conscious pain and suffering before death and eligible survivors’ loss of financial support and companionship.
