Man dies in Spencer Township rollover crash

A 51-year-old Montcalm County man died at the scene of a pickup crash Tuesday morning.

Deputies with the Kent County Sheriff’s Office responded just after 9 a.m. Oct. 6 to Lincoln Lake Avenue near 19 Mile Road in Spencer Township.

His pickup was heading south when it left the road, rolled several times and hit a tree. He was the only person in the truck.

The road was temporarily blocked while authorities responded. The sheriff’s office is investigating the cause.

Michigan benefits and claims after a fatal single-vehicle crash

Michigan no-fault benefits may be available after a fatal crash even when no other vehicle is involved. Eligibility does not depend on proving another driver’s fault, but insurance requirements and exclusions under Michigan law still apply.

Under MCL 500.3108, qualifying dependents may receive survivor’s loss benefits to help replace financial support lost after a fatal motor vehicle crash. The benefits also include reasonable expenses of up to $20 a day for ordinary and necessary services the person would have performed for those dependents. Benefits are payable during dependency within the first three years after the crash and are subject to a combined limit for each 30-day period, adjusted annually.

A wrongful death lawsuit is separate from no-fault benefits. The Michigan Court of Appeals has explained that the death must result from another party’s wrongful act, neglect or fault that would have supported a claim if the person had survived. The estate’s personal representative, the person authorized to act for the estate, must bring the lawsuit.
