Missouri man killed in Buena Vista Township crash

A Missouri man died Thursday morning after his pickup was hit by a semi-truck and a cement truck.

The Buena Vista Township Police Department said the crash happened just after 11 a.m. Aug. 27 at M-81 and North Portsmouth Road.

Police said the man was driving a white Ford F-150 south on North Portsmouth Road when he drove through the intersection without stopping. A westbound semi-truck hit the pickup, causing it to spin before an eastbound cement truck hit it and knock it into a nearby ditch.

The pickup driver died from his injuries. Police said the semi-truck and cement truck drivers were taken to a hospital with what were believed to be minor injuries.

The intersection was closed for more than two hours while crews investigated. The investigation remains ongoing.

Michigan benefits and wrongful-death claims after a fatal vehicle crash

Michigan law separates a wrongful-death lawsuit from possible no-fault survivor benefits. Under MCL 600.2922, a wrongful-death claim requires proof that another person’s wrongful act, neglect or fault caused the death. Damages may include reasonable medical and funeral expenses, conscious pain and suffering, lost financial support and loss of society and companionship.

MCL 500.3108 provides survivor’s loss benefits for after a motor vehicle death. Those benefits can include lost support and certain replacement-service expenses, but eligibility depends on applicable insurance rules. The benefits are not payable beyond the first three years after the accident.

Michigan Legal Center’s guide to Michigan wrongful-death deadlines explains why estate authority, the underlying claim and other notice rules can affect the filing timeline.
