76-year-old Marquette motorcyclist dies after K.I. Sawyer crash
A 76-year-old Marquette man died in a motorcycle crash after colliding with a passenger car in K. I. Sawyer Air Force Base.
Forsyth Township Police said first responders were dispatched about 4:24 p.m. on Thursday, Aug. 13 to the intersection of 5th Street and Avenue B. The motorcyclist was taken to UP Health System – Marquette, where he died.
Police had not released the man’s name Friday morning while officers notified his family. The crash remained under investigation.
Forsyth Township Police were assisted by Forsyth Township EMS and Fire, UP Health System – Marquette EMS, Michigan State Police, the Marquette County Sheriff’s Office, the Michigan State Police Accident Investigation Team and Heavy Hooker Towing.
Michigan insurance and wrongful-death claims after a motorcycle crash
Michigan law separates no-fault benefits from claims based on fault. The Michigan Department of Insurance and Financial Services explains that a motorcyclist injured in a crash involving a motor vehicle may be entitled to personal injury protection medical benefits, usually through the insurer of the motor vehicle’s owner or registrant. Coverage limits and other circumstances can change the result.
Depending on the applicable coverage, no-fault benefits may also include funeral expenses and survivor’s loss benefits after a death. A separate wrongful-death claim requires proof that another party’s wrongful act, neglect or fault caused the death. MCL 600.2922 requires the estate’s personal representative to bring that action.
