Michigan wrongful death claims after a fatal pedestrian crash
A wrongful death lawsuit may be available when another person's wrongful act, neglect or fault causes a pedestrian's death.
Under Michigan's wrongful death law, MCL 600.2922, the lawsuit must be brought by the estate's personal representative, the person authorized to act for the deceased person's estate. Eligible family members, including parents, may receive compensation through that lawsuit. Michigan Legal Center's explanation of who can file a Michigan wrongful death lawsuit describes the personal representative's appointment through probate court.
Depending on the losses proved, compensation could include loss of companionship and reasonable medical, hospital, funeral and burial expenses for which the estate is responsible. The estate may also recover for conscious pain and suffering between the injury and death.
