1 killed, 1 injured in U.S. 2 crash in Crystal Falls Township
One person died and another was injured Thursday, Nov. 5, when a pickup towing a trailer collided with a car.
The Iron County Sheriff's Office said the crash happened on U.S. 2 near Pentoga Trail in Crystal Falls Township.
The car's only occupant died at the scene. An occupant of the pickup was taken to Aspirus Iron River Hospital for treatment of crash injuries.
Both lanes of U.S. 2 between Bates-Amasa Road and U.S. 141 were closed for several hours but have reopened. The sheriff's office is still investigating the cause of the crash.
Who can file a wrongful death lawsuit after a Michigan crash?
Michigan's wrongful death law requires the personal representative of the deceased person's estate to file the lawsuit. That is the person authorized to act for the estate, even when surviving relatives are the ones seeking compensation.
A claim must be based on a wrongful act, negligence or other fault that caused the death and would have allowed the person to recover damages had they survived. Depending on the losses proved, damages can include reasonable funeral and burial expenses the estate is responsible for, lost financial support and loss of companionship.
If no personal representative has been appointed, a lawyer can help the family address that probate step before filing. Michigan Legal Center's explanation of Michigan wrongful death claims and deadlines discusses the estate requirement and filing time limits.
