A Michigan injury attorney’s take on dealing with reasonable mid-sized insurers
As an experienced Michigan injury attorney, I know that all insurance carriers are not created equal. Big insurance carriers will woo customers with low rates and slick ads, but they are tight with their wallets when it comes to settlement of claims. Mid-sized companies, on the other hand, don’t do much advertising and may charge higher premiums, but they generally try to avoid litigation by offering reasonable settlements. These mid-sized companies are both national and regional.
The benefits of a mid-sized insurer.
Mid-sized insurers will usually consider the strength of a plaintiff’s case, rather than try to chip away at it to justify a lower settlement. These companies tend to favor mediation over lawsuits, and are more likely to settle out of court than large, conservative insurers. It’s important that your Michigan injury attorney be experienced enough to recognize the differences in the settlement strategy between an adjuster at a large insurance company and one at a mid-sized company.
Here is a not unusual example of an exchange between an adjuster who works for a reasonable mid-sized insurer and a Michigan injury attorney: The attorney attempts to resolve a case by sending the adjuster a demand package. When he receives no response after 30 days, the attorney sends a polite reminder. After another thirty days, the attorney starts making phone calls, to no avail. Finally, close to ninety days after the initial demand package was sent, the attorney files suit and sends the adjuster a copy of the complaint, noting that settlement is still a welcome possibility. Now the adjuster calls to request a meeting.
At the meeting, the adjuster apologizes and makes a reasonable settlement offer on the case in question, as well as on every other case that the adjuster and attorney have in common. Since then, the attorney and this adjuster have been able to resolve all their cases with just a few phone calls.
