Car Accidents in Michigan

Mt Morris Twp., MI – Car Accident on N Elms Rd near W Pierson RdDealing with the aftermath of a car accident can be overwhelming and stressful. Every year, tens of thousands of crashes across the state leave people with serious injuries. For those affected, one of the most important steps they can take is to pursue legal action against the responsible party. Working with a car accident lawyer can give you a better chance of proving that another driver’s negligence caused the accident. To succeed in a negligence lawsuit, you need to establish five key elements:

  • Duty of Care: The first step is showing that the other driver owed you a duty of care. This means proving that they had a legal responsibility to act in a way that would keep others safe on the road. Every driver has this duty to follow traffic laws and drive safely.
  • Breach of Duty: Next, you need to demonstrate that the other driver did not meet their duty of care. This could mean they were speeding, distracted, or breaking traffic laws. Any reckless or careless behavior that puts others at risk can be considered a breach of this duty.
  • Causation in Fact: You must then prove that the other driver’s actions were a direct cause of your injuries. This means showing that their negligence directly led to the crash and the harm you suffered.
  • Proximate Cause: You will also need to establish that the other driver’s actions were foreseeable and naturally connected to the injuries you sustained. In other words, it must be clear that their behavior was likely to cause the kind of accident and injuries that occurred.
  • Damages: Finally, you need to prove that the accident caused you real harm. This can include physical injuries, medical bills, lost income from time off work, or emotional pain and suffering. Your lawyer will help gather evidence to show the financial and non-financial losses you’ve experienced.

To build a strong case and ensure you have the best chance of securing justice, it is essential to work with an experienced Mt Morris Township car accident lawyer. They will be able to gather evidence, prove these five elements, and show that the crash was not your fault.
