Car Accidents in Michigan

Mt. Morris Twp., MI – Injury Accident on W Pierson Rd at N Linden RdDealing with the aftermath of a car accident can be very difficult. Every year, there are tens of thousands of vehicle collisions in Michigan that result in serious injuries. If you have been in an accident, you might be able to pursue a legal claim against the person responsible. Working with a car accident lawyer can increase your chances of proving that the other party was at fault. To win a lawsuit based on negligence, you must prove five important elements:

  • Duty of Care: You need to show that the person who caused the accident had a legal responsibility to act carefully and not harm you. This means they were expected to follow the rules of the road and drive safely.
  • Breach of Duty: You must prove that the person failed to meet this responsibility. For example, if they were speeding, running a red light, or driving while distracted, they did not act as a reasonable person would have.
  • Causation in Fact: You need to demonstrate that the person’s failure to act responsibly was a direct cause of your injuries. This means showing that your injuries happened because of their actions.
  • Proximate Cause: You must show that the injuries were a foreseeable result of the other person's negligence. In other words, you need to prove that the type of harm you suffered was a likely outcome of their careless behavior.
  • Damages: Finally, you need to prove that you suffered actual harm because of the accident. This could include medical bills, lost wages, and other costs related to the injury. You might also be able to claim for pain and suffering or emotional distress.
