A motor vehicle accident can impact your life in many ways. Not only do victims struggle physically and emotionally, but financially as well. After being hurt in a car crash, victims have the opportunity to file a personal injury claim against the person responsible. In Michigan, comparative negligence is a legal principle that comes into play in personal injury claims arising from car crashes. This concept acknowledges that more than one party may share responsibility for an accident.
In the context of personal injury cases following motor vehicle collisions, Michigan follows a modified comparative negligence system. This means that if a person is injured in a motor vehicle accident and is found partially at fault for the crash, the amount of compensation they are able to recover may be reduced in proportion to their degree of fault. However, if an individual is determined to be 50% or more at fault, they may not be eligible to recover damages.
