A car accident can drastically change your life. Unfortunately, many people are injured every year in Michigan due to vehicle crashes. In fact, car accidents are one of the leading causes of accidental injuries and deaths across the state. If you are hurt in a car crash, you have the right to file a personal injury claim against the person responsible for the accident.
Michigan uses a concept called "comparative negligence" in personal injury claims related to accidents. This means that if you are injured and seek compensation, you must show that the other person was at least partially responsible for causing the crash. However, your own level of fault will also affect the compensation you might receive.
If it is determined that you are more than 50% responsible for the accident, you cannot recover non-economic damages. This means you would be unable to seek compensation for things like pain and suffering, emotional distress, or loss of enjoyment of life. On the other hand, even if you are partly to blame, you can still recover economic damages. These include compensation for lost wages, medical expenses, and other financial losses you face after the crash.
Proving that another driver’s negligence caused the accident is crucial in making sure you get the most compensation possible. Working with a Warren car accident attorney can help you build a strong case by gathering the necessary evidence and presenting it in court.
