A car accident can change your life in an instant, and unfortunately, many people in Michigan experience this reality every year. Vehicle crashes are a leading cause of both injuries and fatalities across the state. If you have been injured in a car accident, you have the right to file a personal injury claim against the person responsible for the crash.
Michigan follows a legal system known as "comparative negligence" when handling personal injury claims. This means that to seek compensation for your injuries, you must demonstrate that the other driver was at least partially at fault for the accident. However, the compensation you may receive can be reduced based on your own level of responsibility for the crash.
If it is determined that you are more than 50% responsible for the accident, you will not be eligible to recover non-economic damages, such as compensation for pain and suffering, emotional distress, or loss of enjoyment of life. Nevertheless, even if you share some of the fault, you can still seek economic damages, including compensation for medical bills and lost wages. It is essential to prove the other driver’s negligence to maximize the compensation you can recover.
Working with a skilled Calhoun County wrongful death lawyer can significantly improve your chances of success. An experienced attorney will help gather the necessary evidence to build a strong case and ensure that your legal rights are upheld throughout the process.
