Fatal Car Accidents in Michigan

Madison Heights, MI – Teen Killed in Crash on I-75 near 14 Mile RdDriving is inherently risky, but when drivers take unnecessary risks, the chances of a severe or even fatal car accident increase significantly. If you have lost a loved one due to the reckless actions of another driver, it is completely understandable that you are feeling devastated and overwhelmed.

While no financial settlement can ever truly replace the loss of a loved one, receiving compensation can help provide some financial stability during this difficult time. In Michigan, certain family members have the legal right to file a wrongful death lawsuit to seek damages. To do so, one family member must be chosen as the representative to bring the claim forward. Michigan law allows the following relatives of the deceased to file a wrongful death lawsuit:

  • Parents of the deceased
  • Spouse of the deceased
  • Children of the deceased
  • Siblings of the deceased

Additionally, individuals who are named in the deceased’s will or are legally entitled to inherit from the estate, such as aunts, uncles, or cousins, may also file a wrongful death claim if none of the above relatives are alive at the time of death.

The negligent driver responsible for your loved one’s death or severe injuries in a Michigan car accident should be held accountable for their actions. It is important to understand that most wrongful death lawsuits are initiated by grieving families seeking fair compensation for the financial burdens that result from losing a loved one.

If your family member's death was caused by a driver's negligence, you have the right to pursue legal action against them. A wrongful death claim could potentially provide you with compensation for:

  • Financial and emotional impacts: This includes the pain and suffering experienced due to the sudden and traumatic loss, covering the mental anguish and grief that accompany such a tragedy.
  • Loss of your loved one’s support and guidance: Known as loss of consortium, this compensation covers the emotional and practical support that your loved one would have continued to provide.
  • Funeral and burial expenses: These costs can be substantial and are often unexpected, placing an additional financial strain on the family.
  • Medical and healthcare costs: If your loved one received medical treatment before their passing, these expenses can be significant and add to the financial burden.
