Our thoughts go out to those injured as a result of this collision.
A car crash can have a devastating impact on your life. The immediate aftermath can involve physical injuries, emotional trauma, and financial burdens. Unfortunately, there are countless instances where people are harmed as a result of vehicle crashes in Michigan. In fact, motor vehicle collisions are one of the leading causes of accidental injuries and deaths statewide each year. The ripple effect of an accident can impact not only the victims but also their families and communities.
After being hurt in a car crash, victims have the ability to file a personal injury claim against the responsible party. This process can be complex and requires gathering substantial evidence, such as police reports, medical records, and eyewitness testimonies. Michigan's legal system utilizes "comparative negligence" regarding personal injury claims arising from accidents. This means that when you've suffered an injury and seek compensation, you must demonstrate that the other party was at least partially at fault for causing the accident.
However, the degree of your fault is crucial in determining your potential compensation. If you were found to be more than 50% responsible for the accident, you are barred from seeking non-economic damages such as pain and suffering, emotional distress, and loss of enjoyment of life. This aspect of the law underscores the importance of accurately establishing fault and gathering robust evidence to support your claim.
Despite being partially responsible, you can still recover economic damages, such as lost wages and medical expenses you face following your crash. Economic damages can also include costs related to rehabilitation, ongoing medical treatments, and any necessary modifications to your living environment. It is important that you can prove your case was caused by another driver's negligence so that you can maximize your recovery. This can involve hiring experts to reconstruct the accident or obtaining detailed medical evaluations to document the extent of your injuries.
Working with a dedicated Flint car accident lawyer will help to ensure you have the strongest evidence for your case. An experienced attorney can guide you through the legal process, negotiate with insurance companies on your behalf, and represent you in court if necessary.
