Experiencing a car accident is something that no one wants to think about, but unfortunately, it's a reality for many people in Michigan every year. Car crashes rank as one of the top reasons people suffer from accidental injuries or lose their lives across the state. If you find yourself injured because of a car crash, you have the option to seek justice and compensation by filing a personal injury claim against those responsible.
In Michigan, the law uses a principle known as "comparative negligence" for personal injury claims related to accidents. This essentially means that if you're seeking compensation for an injury, you need to show that the other person involved bears some level of responsibility for what happened.
Your own level of responsibility in the accident is also taken into account and this can affect the amount of compensation you might receive. For example, if it's determined that you are more than 50% at fault for the accident, you won't be able to claim compensation for non-economic damages, which includes things like pain and suffering, emotional stress, and loss of enjoyment in life activities.
However, even if you are found partly at fault, you're still entitled to claim economic damages. These can cover costs such as medical bills for your injuries and lost wages if you're unable to work. It's crucial to present a strong case showing that another driver's carelessness contributed to the accident, to secure the compensation you need. This is where having a knowledgeable car accident lawyer in Macomb can make a big difference.
